Categories of personal data, purposes and legal bases for data processing

As a rule, you can use our website without any need to disclose us any of your personal data. We collect and use your personal data only insofar as this is necessary to provide a functional website and our content and services (Art. 6 para. 1 sentence 1 lit. f) GDPR). Furthermore, we only store the information transmitted by an internet provider (IP address, date and time of the request, website viewed) for data security purposes in order to ensure that unauthorised access to our web server can be traced if necessary and the data that you have voluntarily provided to us via our website, our contact form or by e-mail (such as your name and e-mail address) in order to process your enquiries (Art. 6 para. 1 sentence 1 lit. b) or f) GDPR). Insofar as personal data (such as name, address or e-mail address) is collected on our website, this is done, as far as possible, on a voluntary basis on the basis of your separate prior consent in accordance with Art. 6 para. 1 sentence 1 lit. a) GDPR. This data will not be passed on to third parties without your express consent. If a contractual relationship between you and us is to be established, developed or amended, or if you send us an enquiry, we collect and use your personal data insofar as this is necessary for these purposes (inventory data). We collect, process and use personal data insofar as this is necessary to enable you to use the website (usage data). Data processing is carried out on the basis of Art. 6 para. 1 sentence 1 lit. b) GDPR.

Duration of storage and disclosure of data

All personal data will only be stored for as long as is necessary for the stated purpose (processing your enquiry or handling a contract). Mandatory statutory provisions, in particular retention periods under tax and commercial law, are taken into account. By order of the competent authorities, we may provide information about this data (inventory data) in individual cases, insofar as this is necessary for the purposes of criminal prosecution, to avert danger, to fulfil the statutory duties of the constitutional protection authorities or the Military Counter-Intelligence Service or to enforce intellectual property rights.

We also use various service providers (e.g. accounting, consulting, website support, suppliers) for order processing. In this way, we ensure that our services to you run smoothly. In individual cases, it may be necessary to pass on personal data for this purpose, whereby the provisions of the General Data Protection Regulation are complied with. The legal basis for the transfer of data is Art. 6 para. 1 sentence 1 lit. a), b) and or f) GDPR. The transfer may be related to the fulfilment of a contract or necessary for the implementation of pre-contractual measures. Alternatively, it is related to our legitimate interest in effective processing or your consent.

The data collected on the basis of your consent will be deleted as soon as it is no longer required for our recording purposes or as soon as you withdraw your consent.

Google Analytics / Google Analytics 4

If you have given your consent, Google Analytics is used on this website. This is a web analysis service of Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043 USA, represented in the European Economic Area and in Switzerland by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland (‘Google’).

Google Analytics uses cookies that enable us to analyse your use of our website. The information collected by the cookies about your use of this website is usually transferred to a Google server in the USA and stored there.

In Google Analytics 4, the anonymisation of IP addresses is activated by default.

However, due to the activation of IP anonymisation, your IP address will be shortened beforehand by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and truncated there. On behalf of the operator of this website, Google will use this information to analyse your use of the website, to compile reports on website activity and to provide the website operator with other services relating to website activity and internet usage. The IP address transmitted by your browser as part of Google Analytics will not be merged with other Google data.

With the help of the Google Analytics tracking tool, the behaviour of visitors to the website can be evaluated and their interests analysed. A pseudonymised user profile is created for this purpose. During your website visit, your user behaviour is recorded in the form of ‘events’. Events can be:

  • Page views
  • First visit to the website
  • Start of the session
  • Your ‘click path’, interaction with the website
  • Scrolls (whenever a user scrolls to the end of the page (90%))
  • Clicks on external links
  • Internal search queries
  • Interaction with videos
  • File downloads
  • Ads viewed / clicked on
  • Language setting

Also recorded:

  • Your approximate location (region)
  • Your IP address (in abbreviated form)
  • Technical information about your browser and the end devices you use (e.g. language setting, screen resolution)
  • Your internet provider
  • The referrer URL (via which website/advertising medium you came to this website)

The purpose of the data processing is to analyse the use of the website and to compile reports on activities on the website. The reports provided by Google Analytics are used to analyse our website.

The recipient of the data is Google as the processor. Google LLC, based in the USA, and, if applicable, US authorities may access the data stored by Google. We have concluded a corresponding data processing agreement with Google for this purpose. Google LLC certifies compliance with the principles of the EU-US data protection agreement ‘Data Privacy Framework’ and thus guarantees an appropriate level of protection for data processing. This enables the lawful transfer of personal data to a third country in accordance with European data protection regulations (see Art. 45 GDPR). To find out more about the ‘Data Privacy Framework’ (DPF) and to view the list of DPF-certified companies, please visit https://www.dataprivacyframework.gov/

You can find Google's order data processing conditions at https://business.safety.google/intl/de/adsprocessorterms/

The data is deleted as soon as it is no longer required for our recording purposes.
You can prevent Google from collecting the data generated by the cookie and relating to your use of the website (including your IP address) and from processing this data by Google by either not giving your consent to the setting of the cookie or by downloading and installing the browser add-on to deactivate Google Analytics at the link https://tools.google.com/dlpage/gaoptout?hl=de.

You can also prevent the storage of cookies by configuring your browser software accordingly. However, if you configure your browser to reject all cookies, this may limit the functionality of this and other websites.

The legal basis for this data processing is your consent, Art. 6 para. 1 sentence 1 lit. a) GDPR. You can revoke your consent to the storage of data and its use at any time. The legality of the data processing operations that have already taken place remains unaffected by the cancellation.

You can find more information on the terms of use of Google Analytics and on data protection at Google at https://marketingplatform.google.com/about/analytics/terms/de/ and at https://policies.google.com/?hl=de.

Facebook Pixel

Within our online offer, the so-called ‘Facebook pixel’ of the social network Facebook is used, which is operated by Meta Platforms Ireland Limited, 4 Grand Canal Quare, Dublin 2, Ireland (‘Facebook’).

If a user clicks on an advert placed by us that is displayed on Facebook, an addition is added to the URL of our linked page by Facebook Pixel. If our site allows the sharing of data with Facebook via pixels, this URL parameter is written to the user's browser via a cookie, which our linked site sets itself. This cookie is then read by Facebook Pixel and enables the data to be forwarded to Facebook.

With the help of the Facebook pixel, Facebook is able to determine the visitors to our online offering as a target group for the display of adverts (so-called ‘Facebook ads’). Accordingly, we use the Facebook pixel to display the Facebook ads placed by us only to those Facebook users who have also shown an interest in our online offering or who have certain characteristics (e.g. interests in certain topics or products determined on the basis of the websites visited), which we transmit to Facebook (so-called ‘custom audiences’). With the help of the Facebook pixel, we also want to ensure that our Facebook ads correspond to the potential interest of users and are not annoying. This also allows us to analyse the effectiveness of Facebook ads for statistical and market research purposes by tracking whether users were redirected to our website after clicking on a Facebook ad (known as ‘conversion’).

The data collected is anonymous for us, so it does not allow us to draw any conclusions about the identity of the user. However, the data is stored and processed by Facebook so that a connection to the respective user profile is possible and Facebook can use the data for its own advertising purposes in accordance with the Facebook Data Usage Policy (https://www.facebook.com/about/privacy/). The data can enable Facebook and its partners to place adverts on and off Facebook.

The data processing associated with the use of the Facebook pixel is only carried out with your express consent on the basis of Art. 6 para. 1 sentence 1 lit. a) GDPR. You can revoke your consent to the storage of data and its use at any time. The legality of the data processing operations that have already taken place remains unaffected by the cancellation.

The information generated by Facebook is generally transmitted to a Facebook server and stored there; this may also involve transmission to the servers of Meta Platforms Inc. in the USA. Meta certifies compliance with the principles of the EU-US data protection agreement ‘Data Privacy Framework’ and thus an appropriate level of protection for data processing is guaranteed.

You can find Facebook's order data processing conditions at https://www.facebook.com/legal/terms/dataprocessing.

Google Tag Manager

We use the Google Tag Manager of Google Ireland Limited, Gordon House, 4 Barrow St, Dublin, D04 E5W5, Ireland on this website. This service allows website tags to be managed via an interface. The Google Tool Manager only implements so-called tags. This means that no cookies are used and no personal data is collected. The Google Tool Manager triggers other tags, which in turn may collect data. However, Google Tag Manager does not access this data. If deactivation has been carried out at domain or cookie level, it remains in place for all tracking tags, provided that these are implemented with the Google Tag Manager.

Google only accesses anonymised data for the use and application of our Tag Manager. We therefore agree to the anonymous transfer of our website data. Google deletes all information that could identify our website. Google summarises the data with hundreds of other anonymous website data and compiles it as part of benchmarking measures and user trends. The information collected can also be used to optimise processes.

The use of Google Tag Manager requires your consent, which we have obtained with our cookie consent management in accordance with Art. 6 para. 1 sentence 1 lit. a) GDPR. In addition to your consent, there is a legitimate interest in the evaluation to improve our offer in accordance with Art. 6 Para. 1 S. 1 lit. f) GDPR.

In the event that personal data is transferred to Google LLC. based in the USA, the data transfer to the USA is based on the EU-US data protection agreement ‘Data Privacy Framework’. The Google Ads Data Processing Terms can be found at https://business.safety.google/adsprocessorterms/. Further information can be found at: https://support.google.com/tagmanager/answer/6102821?hl=de&ref_topic=3441530

You can find more information about Google's privacy policy at the following Internet address: https://www.google.de/policies/privacy/

You can permanently deactivate cookies for ad preferences by preventing them by setting your browser software accordingly or by downloading and installing the browser plug-in available at the following link:

https://www.google.com/settings/ads/plugin?hl=de.

Please note that if you have deactivated the use of cookies, you may not be able to use certain functions of this website, or only to a limited extent.

Matomo

For statistical analysis, this website uses ‘Matomo’ (formerly ‘PIWIK’) - a service provided by InnoCraft Ltd, 150 Willis St, 6011 Wellington, New Zealand. With the help of Matomo, we are able to collect and analyse data about the use of our website by website visitors. This enables us to find out, among other things, when which pages were accessed and from which region. We also record various log files (e.g. IP address, referrer, browser and operating system used) and can measure whether our website visitors perform certain actions (e.g. clicks, purchases, etc.).

This analysis tool is used on the basis of Art. 6 para. 1 lit. f GDPR. The website operator has a legitimate interest in analysing user behaviour in order to optimise both its website and its advertising. If a corresponding consent has been requested, the processing is carried out exclusively on the basis of Art. 6 para. 1 lit. a GDPR and § 25 para. 1 TTDSG, insofar as the consent includes the storage of cookies or access to information in the user's terminal device (e.g. device fingerprinting) within the meaning of the TTDSG. Consent can be revoked at any time.

Social media appearances

We maintain online presences within social networks and platforms in order to communicate with the applicants, customers, interested parties and users active there and to inform them about our services.

We would like to point out that you use these pages and their functions on your own responsibility. This applies in particular to the use of the interactive functions (e.g. commenting, sharing, rating). Alternatively, you can also access the information we offer on our website https://www.wuttke-ingenieure.de/.

When you visit our various online presences, the respective provider of the website collects your IP address and other information that is stored on your PC in the form of cookies. The data collected about you in this context is processed by the respective provider and may be transferred to countries outside the European Union. What information the service providers receive and how it is used is described in general terms in their respective data usage guidelines. There you will also find information about contact options and the setting options for adverts.

As the provider of the information service, we also collect and process data from your use of our service for the purpose of advertising and communication, answering your questions and various products, services and events, as well as for the purpose of recruiting employees. The legal bases are Art. 6 para. 1 sentence 1 lit. f) and b) GDPR.

In the case of requests for information and the assertion of user rights, we would also like to point out that these can be asserted most effectively with the providers. Only the providers have access to the user's data and can take appropriate measures and provide information directly. Should you nevertheless require assistance, you can of course contact us.

Fanpages

Facebook and Instagram

We operate fan pages of the online providers Facebook.com and Instagram.com of Meta Platforms Ireland Limited, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland (‘Meta’ or ‘Facebook’ and/or ‘Instagram’) in order to communicate with you and other interested parties and to provide information about us and our range of services.

We process the following categories of data:

  • Communication content such as messages and comments
  • ‘Like’ or follow information
  • Profile information such as pictures and other information published by you
  • The above-mentioned data may also include special categories of personal data, the processing of which is privileged in accordance with Art. 9 para. 2 lit. e) GDPR.

The legal basis for this data processing is Art. 6 (1) (f) GDPR, based on our legitimate interest in communicating with you, informing you, and leveraging the reach of Facebook and/or Instagram.

We have no influence on data processed by Meta on its own responsibility in accordance with Meta's terms of use. Due to the constant development of Meta, the availability and processing of data is changing. For further information, please refer to the privacy policies of Facebook and/or Instagram: https://de-de.facebook.com/privacy/policy and https://privacycenter.instagram.com/.

Please note: Meta also determines the user's IP address for logged-in visitors. If you are a Facebook and/or Instagram member and are logged in to your Facebook and/or Instagram profile when you visit our fan page, Facebook and/or Instagram will link your visit to your personal user account.

If you follow our respective fan page or "Like" it, Facebook and/or Instagram will add your profile to the list of all fans and make it accessible to us. We can only see the public information of the profile. You decide what this information is in your Facebook and/or Instagram settings. You also have the option of actively hiding your "Like" or unfollowing the fan page in your Facebook and/or Instagram settings (https://www.facebook.com/settings?tab=privacy or https://www.instagram.com/accounts/login/?next=/accounts/privacy_and_security/). Your profile will then no longer appear in the list of fans of this fan page.

Facebook and/or Instagram provide us with statistics about our fans. This is anonymous demographic data, such as age, gender, or place of residence. We use these statistics to select relevant information for our posts or to commission targeted advertising on Facebook and/or Instagram for relevant groups. We cannot link the statistical data with the profile data of our fans. You have the option to opt out of targeted advertising in your Facebook and/or Instagram settings.

The personal data of users from the European Union remains in data centers within the EU. However, access to the data by US security authorities cannot be completely ruled out. Meta certifies compliance with the principles of the EU-US Data Privacy Framework, thus ensuring an adequate level of protection for data processing. This allows for the lawful transfer of personal data to a third country in compliance with European data protection regulations (Article 45 GDPR).

To the extent that we process your personal data when operating the fan page, you are entitled to the rights stated in this privacy policy. If you wish to assert your additional rights against Meta, the easiest way to do so is to contact Meta directly. Meta is familiar with the details of the technical operation of the platform and the associated data processing, as well as the specific purposes of the data processing, and can implement appropriate measures upon request if you exercise your rights. We will be happy to support you in asserting your rights to the extent possible and will forward your inquiries to Meta.

  • Communication content such as messages and comments
  • "Like" or "Follow" information
  • Profile information such as images and other information you have published
  • The above-mentioned information may also include special categories of personal data, the processing of which is, however, privileged under Art. 9 (2) (e) GDPR.

We have no influence on the type and scope of the data processed by LinkedIn, the manner of processing and use, or the transfer of this data to third parties. We also have no effective control options in this regard.

Using cookies or similar technologies, LinkedIn can also identify you outside of its own services and across different devices. LinkedIn collects and analyzes data from the content, news, and messages you publish and upload, as well as data from partners and affiliates, such as information provided by your workplace/training institution, websites, or third-party services. For more information, please visit: https://www.linkedin.com/legal/privacy-policy.

In principle, all information that you provide in your so-called "public profile" is also visible outside of LinkedIn and in search engines. Even with a non-public profile, members who log into the network and customers of LinkedIn services can see the content. This also applies to your activities within the service, such as comments on posts, "likes" or the "follow" function. Group memberships are also publicly visible. When you share posts, the default setting is to make them public. In the options, you can limit the visibility of these posts to your contacts.
